Terms of Service - Vocal AI

Welcome to Vocal AI, a software platform operated by Wixpa LLC ("Company", "we", "us", or "our"). By accessing or using our application, website (vocal.crustcommerce.com), or services, you agree to be bound by these Terms of Service.

1. SMS / Mobile Messaging Terms (IMPORTANT)

If you or your customers opt-in to receive SMS messages from Vocal AI or merchants using our platform, the following terms strictly apply:

Program Description: Users who explicitly opt-in will receive automated promotional offers and abandoned cart reminder text messages from the respective merchant, powered by Vocal AI.
Message Frequency: Message frequency varies based on user interaction, purchase history, and cart activity.
Pricing Disclosure: Message and data rates may apply.
Opt-Out Instructions: You can cancel the SMS service at any time. Just text "STOP" to the shortcode or number sending the message. After you send the SMS message "STOP", we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from that number.
Help Instructions: If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance, or get help directly by contacting the merchant or emailing us at support@wixpa.com.
Carrier Liability: Mobile carriers are not liable for delayed or undelivered messages.

2. Use of the Service

Vocal AI provides integrated software for Shopify merchants. You agree to use the service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the service complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA) and Cellular Telecommunications Industry Association (CTIA) guidelines regarding communication with your customers.

3. Privacy

Your use of the service is also governed by our Privacy Policy. We take data protection seriously. Text messaging originator opt-in data and consent will not be shared with or sold to any third parties, affiliates, or partners for marketing or promotional purposes. 4. Merchant Responsibilities

Merchants utilizing Vocal AI are strictly responsible for collecting compliant, express written consent from their end-users prior to initiating any SMS communications. Merchants must display clear calls-to-action (CTAs) at the point of opt-in as required by law.

5. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. Wixpa LLC makes no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the service.

6. Limitation of Liability

In no event shall Wixpa LLC be liable for any indirect, incidental, special, or consequential damages, including penalties incurred due to non-compliance with local messaging laws, arising out of or in connection with your use of Vocal AI.

7. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any significant changes. Your continued use of the service following the posting of revised Terms means that you accept and agree to the changes.
